Here are some of the most important laws regarding motorcycle usage in the state of California:
- All motorcycle riders, regardless of age, must wear a safety helmet at all times. This is true regardless of whether you’re a driver or passenger
- California is the only state in the union where the practice of lane splitting (taking your motorcycle between the lanes of traffic) is legal. But be very careful when doing this
- Earplugs are allowed, though you must be able to hear sirens and horns
- Eye protection is not required
- Every motorcycle manufactured after 1978 must use its headlight during the day
- Both a right and left rearview mirror is required
- There are no age restrictions for passengers.
In addition to these laws, all motorcycles must have functioning brake lights and those built after 1973 must have two turn signals as well.
These laws exist for your safety. Following them – especially the safety helmet provision – can help keep you alive. What’s more, following the laws provides you with stronger legal footing in the case of an accident. Take the helmet law for example: if you don’t wear a helmet and you’re in an accident, you can still pursue compensation. You’re not prevented from doing so based on that decision. However, an opposing attorney can claim that you contributed to your injuries by not wearing a helmet, and your compensation could be reduced accordingly.
